These Terms of Use govern your access to and use of NDS, including its website, dashboards, and related services (collectively, the “Service”). By creating an account, clicking to accept these Terms, or using the Service, you agree to them and to the Privacy Policy. If you do not agree, do not use the Service.
These Terms are a working draft. They have not yet been reviewed by qualified counsel and will be revised before they are presented as a final legal agreement. The draft label is deliberate: it is not a substitute for the missing legal review.
NDS is operated by three individual co-founders. There is not yet an incorporated company operating the Service. Until an operator entity and its governing jurisdiction are confirmed, questions about these Terms can be sent to privacy@ndscholars.com.
NDS is an organizational tool for planning and tracking college applications. It lets you store information you choose to enter and view administrator-maintained reference content, such as university records and opportunity listings, with sources and verification dates where available.
NDS does not make admissions decisions, predict outcomes, rank you or other applicants, or guarantee that any college, deadline, cost, requirement, opportunity, or other reference content is complete, current, or right for you. Confirm important information directly with the relevant school, testing organization, or other official source before acting on it.
Student accounts are for high-school students who are at least 13 years old. By creating or using a student account, you confirm that you meet that requirement. We do not knowingly maintain accounts for children under 13. If we learn that an account belongs to a child under 13, we will close the account and delete its data as described in our Privacy Policy.
Keep your sign-in credentials confidential. Do not share your account or use someone else’s account without permission. Notify us promptly at privacy@ndscholars.com if you believe your account has been accessed without authorization.
A student may invite a parent or guardian to a limited, read-only dashboard. The student controls that invitation and can revoke it at any time. Parents and guardians do not receive access to essays, private records, academic or test details, or other information that the Service does not expressly make available to them.
The content you enter remains yours. You give us permission to store it and display it back to you and to people you explicitly invite so the product can function. We claim no other rights to it.
You retain ownership of the information and materials you submit to the Service (“Your Content”). You give NDS a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, display, and back up Your Content only as needed to operate, secure, support, and improve the Service for you and to make it available to people you explicitly authorize.
You are responsible for Your Content and for having the rights needed to submit it. Do not upload or share material that violates another person’s privacy, intellectual-property rights, or applicable law. Our Privacy Policy explains how we collect, use, protect, share, retain, export, and delete information associated with the Service.
Student accounts are for high school students who are 13 years of age or older. Parent and guardian accounts are for adults who are 18 years of age or older. When you create an account, you confirm that you meet the age requirement for the account type you choose, and we keep a record of that confirmation. We do not knowingly create student accounts for children under 13. If we learn that an account belongs to someone who does not meet the applicable age requirement, we will close it and delete its data.
A parent or guardian can create their own account. A student can then invite them to follow shared progress from a parent dashboard. Parents and guardians can view the information the student shares, but cannot edit the student's work. The student can stop sharing at any time.
You are responsible for keeping your credentials private and for the activity on your account.
The Service, its software, design, branding, and administrator-maintained reference content are owned by NDS or its licensors and are protected by applicable intellectual-property laws. These Terms grant you a limited, personal, revocable, non-transferable right to use the Service for its intended purpose. They do not transfer ownership of the Service or its content to you.
You may not copy, sell, license, distribute, publicly display, or create derivative works from the Service or its content except where the law permits it or we give written permission.
Use the Service lawfully, respectfully, and only through its intended interfaces. Do not attempt to access another person’s data, interfere with the Service, impersonate another person, submit false or misleading information, distribute malware, or use the Service to harass, exploit, or harm anyone.
You may not scrape, crawl, spider, bulk-download, or otherwise collect data from the Service using automated means without prior written permission. You may not probe for vulnerabilities, bypass access controls, reverse engineer or decompile the Service except where applicable law expressly permits it, or use the Service in a way that creates an unreasonable load on its systems.
The Service may link to third-party websites or let you choose to connect Google Drive. Those services are governed by their own terms and privacy practices. NDS does not control and is not responsible for third-party content, services, availability, or policies.
If you connect Google Drive, NDS can create and link essay documents in your account using the limited permissions described in the Privacy Policy. Those documents remain in your Google Drive; deleting an NDS account does not delete documents from Google.
We may update, suspend, or discontinue all or part of the Service, including a feature or a reference-content record. We may also suspend or close an account when we reasonably believe that doing so is necessary to protect users, the Service, or the public; to investigate suspected misuse; or to comply with law. Where appropriate, we will provide notice and an opportunity to address the issue.
You may stop using the Service at any time. Student accounts can be deleted from account settings, subject to the retention and externally hosted-document details in the Privacy Policy.
NDS does not currently offer paid plans or collect subscription fees through the Service. If we introduce paid features, we will present the applicable price, billing interval, renewal terms, cancellation process, and refund policy before you are charged. Those terms will be added to this page or to separate terms that clearly identify the paid feature.
Governing law, court jurisdiction, arbitration, warranty disclaimers, limitation of liability, indemnity, and formal notice provisions are not included in this draft because they require a confirmed legal operator, jurisdiction, commercial model, and qualified legal review. No clause on this page should be read as selecting a governing law, requiring arbitration, waiving a class action, or setting a liability cap.
Before these Terms are finalized, counsel should confirm the operator entity, jurisdiction, paid-service terms if any, dispute process, minor-user requirements, and the enforceability of any future warranty or liability provisions.
We may update these Terms as the Service, its legal operator, or applicable law changes. If an update is material, we will post the revised version and update its effective date or version. Where the change requires fresh consent, we will ask you to accept it before you continue using the Service.
